Compliance with Association Rules

Each homeowner within the Windhaven Crossing Community has an obligation to comply with the Declaration of Covenants, Conditions and Restrictions (DCC&R’s), as well as all Rules and Policies set forth in Windhaven Crossing Townhome Owner’s Association, Inc. governing documents. Our community is striving to continue to be a beautiful place to reside where Owners can live in harmony with their neighbors.

It has come to our attention that we have had several compliance violations or compliance related matters occurring throughout the property. As a courtesy, we would like to take this opportunity to remind all homeowners of the top 5 compliance violations covered in the Windhaven Crossing Townhome Owners, Inc. governing documents.

    1. Trash Containers
    2. Exterior Maintenance/ACC (Home, Lawn &/or Misc.)
    3. Unauthorized/Unregistered/Inoperable vehicles/Parking - (Parking in Alleyways prohibited)
    4. Pets / Picking up after your pets. It is the Owners responsibility to pick up after their pets. All pets should be kept on a leash whenever outside the home or fenced yard.
    5. Homeowners encouraged to utilize garage or driveway to park vehicles. On-street parking with exception of temporary delivery drivers etc. is strongly discouraged. Enforceable by city ordinance.

As a reminder below are the Pet Rules and Regulations:

    1. No more than three (3) domesticated household pets are permitted in any Residence with a weight of less than sixty (60) pounds. Pets weighing over sixty (60) pounds is limited to two (2) per household.
    2. Pets shall not be permitted to run free through the Property.
    3. Owners are responsible for cleaning up waste behind their pets and pets must be leashed at all times when in the Common Areas or while walking your pet within the community.
    4. Owners must always clean up pet waste after their pets and shall keep pets on a leash whenever outside the confines of the home or a fenced yard, if applicable.
    5. *Note: The Board of Directors shall have the right to require upon written request the removal of any pet that becomes a nuisance, is allowed to run free or is considered dangerous. Please remember that violations &/or fines may be levied against an owner or resident that is not in compliance with the HOA Governing Documents or City Code/Ordinances.
    6. The Board will be reviewing amendment to CC&Rs to discuss implementation of policies to update Governing Document policies based on the SB1588 (9/2021) legislative changes.

      a. HOA to update policies according to SB1588 and adopt the new pandemic, email registration, security, generator, and drone policies from SB1588.
    7. Discuss amendment of policies to allow for immediate fine no less than $500.00 per occurrence each time the HOA must send vendor to pick-up/dispose of pet waste/feces left from a resident &/or residents’ failure to pick-up after their pet. (Property code allows for written affirmation of eyewitness or video footage provided as proof/evidence required. Board to discuss DNA testing of animal feces. If the HOA must utilize vendor to perform animal DNA testing, all costs associated will be billed back to the Owners account, per occurrence.
